Interview with the Barcelona Court judge · A group of experts is preparing a constitutional document to serve as a foundation for the new Catalan state

The newspaper El Mundo published Sunday a report on what it called "Catalonia's secret constitution for 2014", a draft of a constitution for a new Catalan state that a group of ten experts has been preparing for the last ten months. Santiago Vidal, the Barcelona Court judge who forms part of this group, confirmed yesterday the existence of the document, which is still unfinished. In this interview clarifies some information published by El Mundo and adds additional information. He gives concrete details about some of the articles in this document and insists that it's not an official assignment from any institution or party. He does admit that it comes out of the suggestions from a group of parliament members from various parties. He warns at the outset that he can't explain the entire document, out of prudence and professionalism, but he does talk about mortgage law and term limits, to give a few examples. He also anticipates that there will be no Constitutional Court, but rather a court of judicial power focused on constitutional guarantees, formed by members elected by the citizenry... And he remarks that the new text "has nothing to do with the Spanish Constitution".
Was this constitution an official assignment?
No, it was not, not from the Catalan Government nor from the Parliament. Or from any particular political party. I say that because the journalist from El Mundo who published the information made it seem like it was an official assignment from CiU and Esquerra, and that's not true. There was no official assignment from anyone. Now, it wasn't a personal initiative either, from ten loose cannons. Some members of parliament from some sovereigntist parties suggested it to us last January. That is, that we, as experts, write up a first document to help them out, a first draft or foundational document of the hypothetical future magna carta of the Catalan republic.
Who are the members of the group?
We are a group of judges, constitutional law professors, and also a few lawyers specialized in the matter. I can't tell you names. But that's not significant. You'll find out when we make the document public.
When will that be?
At the end of the year, after the referendum. In fact, according to the result of the referendum, which will determine Catalonia's new status to a fair extent, there are articles that can change. We have sixty of them written so far. And we want, if possible, for there to be no more than one hundred.
A short constitution...
Precisely, one of the things that was very clear to us from the beginning is that we should take inspiration from the Scandinavian constitutions as well as a little from that of the United States. What does that mean? That it be a declaration of real principles and that there be few articles, if possible, no more than one hundred. Remember that the Spanish Constitution has 169, each with subarticles, and then there are the 'additional dispositions', that act like articles. We want at the most one hundred short articles, with a single paragraph each, containing three clear, concise lines. In addition, we want the interpretation of the articles to be able to evolve. They can't be immutable texts. The principal problem with some constitutions, like the Spanish one, is that they use legal protection as an excuse to avoid adapting with the times. The more words an article has, the more difficult it is to adapt to the social reality of changing times. Therefore, it's important to be concise, clear, and use just a few words.
Which are the principal differences with respect to the Spanish Constitution?
They won't be anything alike. The Catalan Constitution will be very different, that I can tell you. It won't resemble the Spanish one at all.
What are the main things that must be changed?
There are many things, but I'll tell you about three of them. that is, in the seventeen chapters that it will have, I'll outline three, that have nothing to do with the Spanish Constitution, even though there are many more differences with the Spanish Constitution. The first is the clarity of the first chapter. This chapter is the one that in democratic state constitutions is dedicated to fundamental rights. The draft constitution that we are proposing is particularly clear and concise in this regard. No long, convoluted definitions.
For example?
Starting with the legal-political configuration of the new state. In this case, I can tell you that in the draft we opt for a republic: a non-presidential republic, with a president and a prime minister, following the German model more than the French one. And the description of fundamental rights: liberty, privacy, etc.
What are the other two chapters that change radically with respect to the Spanish Constitution?
The second is the chapter dedicated to social rights. I'm not in charge of that chapter, because I'm not an expert in that field, but the difference lies in the fact that it won’t be limited to a mere declaration of principles like in the Spanish Constitution. One example: the Spanish Constitution says: "All citizens have the right to decent housing."
Right, which is not fulfilled by a long shot...
Yes, because afterwards they say, "when there is money, when we can..." Well, no. That can't be. Private property, in this case apartments, is always recognized as long as it fulfills a social function, not for speculation. If that is not fulfilled, this private property must be able to be expropriated by the legitimate representatives of the popular sovereignty. This chapter of the draft constitution says similar things, very directly. We are very specific. And, for example, among the six or seven specific rules that regulate this area, there will be a specific prohibition of the speculatory financial system and a very clear opening for the ordinary legislator, who is later the one who has to develop the constitutional mandate into concrete laws, so that they allow, for example, satisfying a mortgage by returning the collateral property in question [currently not permitted under Spanish law]. That would be a big change.
And the third chapter?
It's the one that refers to the legal sphere, which is the one that I'm working on. The idea is to change the current legal system, based on the Spanish model, from top to bottom. We defend a legal system based on proximity, which in the big cities would be divided into districts and neighborhoods, and where a judge can resolve 50-60% of the minor conflicts that come up in day-to-day life, whether they be criminal, civil, labor, administrative, etc. In addition, there will be a mandate to develop laws that strictly regulate the principles of agility and speed, compatible with legal guarantees. Legal suits should last months, not years, no, months.
You also say there won't be a Constitutional Court…
Yes, we are offering the idea that there be no Constitutional Court. That is, the republic must have a supreme court, with functions that unify doctrine and jurisprudence, but with civil, criminal, administrative, social and constitutional guarantees courtrooms. In this way, with a single stroke we solve the problem of politicizing the constitutional court of a state.
Who will form the court of constitutional guaranteees?
While the civil and criminal courts will be formed by five magistrates nominated on the basis of seniority and merit, the constitutional guarantees court will be different. Out of the five magistrates that comprise the court, only two, and thus a minority, will be career judges. The other three will be chosen through free elections: one by the citizens, the second by the ombudspeople, and the third by the law community: law professors, lawyers, solicitors, notary publics, registrars, etc. These people don't necessarily have to be judges. The idea is to open it up to society and make this court be practically impossible to control. That is, it will be practically impossible for anyone to have a majority.
You also talk about setting term limits for the president and ministers…
Yes. There will be term limits for all high-level political positions, a maximum of two legislatures. High-level positions include: president, prime minister, ministers, president of the judiciary, and president of the parliament. Our understanding is that experience shows that the phenomenon of corruption and harmful inertia for a participatory democracy come from the fact that people hold on tightly to their political privileges.
Speaking of corruption, will there also be an organism for controlling public bids?
Yes, the idea is to revitalize and change the makeup of the Anti-Corruption Office, starting by giving it much more independence than it has now. Currently, the Anti-Corruption office is part of the Generalitat. And the idea is that it be a fully independent body.
Would it be filled by nominations from members of parliament?
No, not just that. It would have to be a technical office that doesn't depend on either the Generalitat or the Parliament. The way its members would be nominated still needs to be worked out and it's too soon to talk about, but the office would have to be completely independent of all the other powers of the state, with the specific function, via constitutional mandate, of supervising and controlling all public bids, party financing, etc.
Do you talk about official languages and education in the constitution?
We haven't gotten there yet. Out of the 90 some articles that we’re planning, we've done around 61 or 62. Everything that has to do with culture, healthcare, and education are topics that we'll get to from here on out. In some of those matters we have a very rough outline, but we still haven't talked about them as a group, and so I can't speak about them.
El Mundo published the information on Sunday. Have you gotten any pressure since it was revealed that you're working on this draft?
No, the only requests we've had have been from media publications like yours. And we're not expecting any. What law prohibits a group of experts from thinking about or working on whatever it wants? There is nothing illegal here and we judges that form part of the group are very clear about that. The fundamental law on judicial power outlines a strict framework of rules of incompatibility and clearly states that we are allowed to dedicate our free time to working on technical reports.
You say that you have edited sixty articles so far. What kind of schedule do you anticipate for this first draft of the constitution?
The idea is to not publish anything until the end of the year, after the referendum. And when we speak publicly again, it will be to present the final document, that we will offer to the whole community. So, for now, the schedule is once the referendum has taken place, we will show the society and its institutions this first draft of a constitution of the Catalan Republic so that whoever finds it useful can use it as an inspiration. It's a way of getting work out of the way ahead of time.

El diari El Mundo publicava diumenge una informació sobre allò que anomenava 'la constitució secreta de Catalunya per al 2014', un esborrany de constitució per a un nou estat català que un grup de deu experts prepara des de fa mesos. El jutge de l'Audiència de Barcelona Santiago Vidal, que forma part d'aquest grup, va confirmar ahir l'existència del document, encara inacabat. Però en aquesta entrevista matisa una part de la informació publicada per El Mundo i l'amplia. Dóna detalls concrets d'alguns dels articles d'aquest document que, hi insisteix, no és el resultat de cap encàrrec oficial: ni de cap institució ni de cap partit. Això sí, explica que parteix del suggeriment d'un grup de diputats de partits diversos. Avisa d'entrada que no pot explicar tota la informació, per prudència i per rigor professional, però sí que parla de lleis hipotecàries i de limitació de mandats, per exemple. També preveu que no hi hagi tribunal constitucional, sinó una sala del poder judicial centrada en les garanties constitucionals, formada per membres elegits pels ciutadans... I remarca que el nou text 'no té res a veure amb la constitució espanyola'.
Aquesta constitució ha estat un encàrrec d'algú?
—No, no és cap encàrrec, ni de la Generalitat ni del parlament. Ni de cap partit polític en concret. Ho dic perquè el periodista d'El Mundo que va publicar la informació deixava entendre que era un encàrrec de CiU i d'Esquerra, i això no és cert. No hi ha hagut cap encàrrec oficial de ningú. Ara, no ha estat només una iniciativa pròpia, de deu eixelebrats. Alguns diputats dels partits polítics sobiranistes, el mes de gener passat ens van fer aquest suggeriment. És a dir, que féssim un primer document per a ajudar-los com a experts, un primer esborrany o document de base de la hipotètica futura carta magna de la república catalana.

Qui el formeu, aquest grup?
—Som un grup de jutges, professors de dret constitucional i també un parell d'advocats especialistes en aquesta matèria. Els noms no us els puc dir. I, de fet, això no és significatiu. Ja se sabran quan fem públic el document.

Quan serà, això?
—A final d'any, després de la consulta. De fet, segon el resultat de la consulta, que determinarà en bona part el nou estatus de Catalunya, hi ha articles que poden canviar. Ara en tenim uns seixanta d'escrits. I volem, si pot ser, que no n'hi hagi més de cent.

Una constitució curta…
—Efectivament, una de les coses que vam tenir molt clares des del principi és que calia inspirar-se en les constitucions nòrdiques i una mica en la dels Estats Units. Què vol dir això? Que sigui una declaració de principis reals i que tingui pocs articles, si pot ser no més de cent. Penseu que la constitució espanyola en té 169, cadascun amb subapartats, i a més té disposicions addicionals, que actuen com articles. Nosaltres volem fer a tot estirar un centenar d'articles, curts, amb un sol text o apartat cadascun, de tres línies clares i concises. A més, volem que puguin tenir una interpretació evolutiva. No poden ser textos tancats. El principal problema d'algunes constitucions, com l'espanyola, és que amb l'excusa de la protecció jurídica no es poden canviar per adaptar-se als temps. Com més paraules tingui un article, més difícil és després d'adaptar-lo a la realitat social dels temps canviants. Per tant, cal ser concisos, clars i amb poques paraules.

Quines seran les principals diferències respecte de la constitució espanyola?
—No hi tindrà res a veure. Serà molt diferent, això sí que t'ho puc avançar. No s'hi assemblarà de res.

Quines són les principals coses que cal canviar?
—N'hi ha moltes, però miro de dir-te'n tres. És a dir, dels disset capítols que tindrà, te'n destaco tres, que no tenen res a veure amb la constitució espanyola, tot i que de diferències amb la constitució espanyola n'hi ha moltes més. La primera és la claredat del capítol primer. Aquest capítol és el que en totes les constitucions dels estats democràtics és dedicat als drets fonamentals. L'esborrany de constitució que proposem és especialment clar i concís en aquest àmbit. Res de definicions llargues ni enrevessades.

Per exemple?
—Començant per quina ha de ser la configuració jurídico-política del nou estat. En aquest cas sí que puc dir que en aquest esborrany optem per una república; una república no presidencialista, amb un president i un primer ministre, seguint molt més el model alemany que no pas el model francès. I la descripció dels drets fonamentals: la llibertat, la intimitat, etc.
Quins són altres dos capítols que canvien radicalment respecte de la constitució espanyola?
—El segon és el capítol dedicat als drets socials. D'això no me n'encarrego jo, perquè no sóc expert en aquest àmbit, però la diferència rau en el fet que no hi haurà només una declaració de principis com en la constitució espanyola. Un exemple: la constitució espanyola diu: 'Tot ciutadà té dret a un habitatge digne.'

Sí, és clar, no es compleix ni de bon tros...
—Sí, perquè després diuen 'quan hi hagi diners, quan es pugui…' Doncs no. Això no pot ser així. La propietat privada, en aquest cas dels pisos, es reconeix sempre que compleixi una funció social, no per especular. Si això no es compleix, aquesta propietat privada ha de poder ser expropiada pels legítims representants de la sobirania popular. L'esborrany de constitució en aquest capítol diu coses com aquesta, molt directes. Serem molt concrets. I, per exemple, de l'articulat d'aquestes sis o set normes específiques que regulin aquest àmbit hi haurà una prohibició específica del sistema especulatiu financer i una obertura també molt clara al legislador ordinari, que és qui després ha de desenvolupar el mandat constitucional en lleis concretes, perquè permeti la dació en pagament en el cas d'hipoteques que no es puguin pagar. Això seria un gran canvi.

I el tercer capítol?
—És el que fa referència a l'àmbit judicial, que és aquell a què jo em dedico. La idea és canviar de dalt a baix el model judicial actual, que és el model espanyol. Defensem una justícia de proximitat, que en grans ciutats serà de districte i de barris, on un jutge pugui resoldre el 50% o el 60% dels petits conflictes que es donen en la convivència ciutadana, siguin de l'àmbit penal, civil, laboral, administratiu, etc. A més, hi haurà un mandat per a desenvolupar lleis que regulin el principi d'agilitat i de celeritat, compatible amb el de garanties, d'una manera taxativa. Els plets han de durar mesos; no anys, no: mesos.

També dieu que no hi haurà Tribunal Constitucional…
—Sí, avancem la idea que no hi hagi tribunal constitucional. És a dir, hi ha d'haver un tribunal suprem de la república, amb funcions per a unificar doctrina i jurisprudència, però amb sala civil, sala penal, sala administrativa, sala social i sala de garanties constitucionals. D'aquesta manera solucionem d'un sol cop el problema de la politització del tribunal constitucional d'un estat.

Quins membres formarà la sala de garanties constitucionals?
—Així com les sales civils o penals seran formades pels cinc magistrats nomenats per criteris d'antiguitat i de mèrits, la sala de garanties constitucionals serà diferent. Dels cinc magistrats que la formen, només dos, i per tant minoria, seran jutges de carrera. Els altres tres s'elegiran per elecció lliure: l'un pels ciutadans; el segon pels defensors del poble; i el tercer, elegit pel món jurídic: facultats de dret, advocats, procuradors, notaris, registradors, etc. Aquesta gent no necessàriament han de ser jutges, en absolut. La idea és obrir-ho a la societat i fer que aquesta sala sigui quasi impossible de controlar. És a dir, serà quasi impossible que ningú hi tingui majoria.

També heu parlat de limitar els mandats del president i dels ministres...
—Efectivament. Per a tots els càrrecs d'alta direcció hi haurà una limitació de mandats, que no podran superar les dues legislatures. Càrrecs d'alta direcció vol dir: president, primer ministre, ministres, president del poder judicial i president del parlament. Entenem que l'experiència demostra que el fenomen de la corrupció i de les inèrcies perjudicials per a la democràcia participativa deriven del fet que la gent s'aferri a la butaca.

Parlant de corrupció, també hi haurà un òrgan que controli les adjudicacions públiques?
—Sí, es tractaria de revitalitzar i canviar de forma i de continguts l'Oficina Antifrau, començant per atorgar-li molta més independència que no té ara. Ara l'Oficina Antifrau és un organisme de la Generalitat. I es tracta que sigui un organisme completament independent.

En nomenaria els membres el parlament?
—No, ni tan sols això. Haurà de ser un organisme tècnic que no depengui ni del govern ni del parlament. La manera com se n'hauran de nomenar els membres encara l'hem de treballar i és massa aviat per a parlar-ne, però haurà de ser absolutament independent de qualsevol dels altres poders de l'estat, amb una funció específica, per mandat constitucional, de supervisar i controlar totes les adjudicacions públiques, el finançament de partits, etc.

A la constitució també parleu de llengües oficials o d'educació?
—No hi hem entrat. Dels noranta i escaig articles que volem que tingui, ens trobem entre el 61 i el 62. Tot allò que fa referència a cultura, la sanitat i l'educació, són els temes que abordarem a partir d'ara. D'algun d'aquests punts tenim algun esborrany molt bàsic, que encara no s'ha debatut en el ple del grup de treball, i per tant no en puc parlar.

El Mundo va publicar la informació diumenge. Heu rebut cap mena de pressió, d'ençà que s'ha sabut que treballeu en aquest esborrany?
—No, les úniques peticions que hem rebut han estat de mitjans de comunicació com el vostre. I tampoc no n'esperem res més. Quina llei prohibeix que hi hagi un grup d'experts que es dediqui a pensar o a treballar sobre allò que vulgui? No hi ha res d'il·legal i els jutges que integrem el grup ho tenim molt clar. La llei orgànica del poder judicial ens marca un règim d'incompatibilitats molt estricte i diu clarament que podem dedicar el nostre temps lliure a elaborar informes tècnics.

Dieu que teniu redactats una seixantena d'articles. Quin és el calendari que heu previst per a aquest primer esborrany de constitució?
—La idea és no fer públic res més fins a final d'any, passada la consulta. I quan tornem a parlar públicament ja serà per a presentar el document final, que oferirem a tota la societat. De moment, el calendari és aquest: un cop feta la consulta, mostrarem a la societat i a les institucions aquest primer esborrany de constitució de la república catalana perquè, qui ho cregui convenient, el pugui utilitzar com a inspiració. És una manera d'anar avançant feina.
